Can you use an AI scribe for therapy and mental health?

Summary

Most ambient scribes were built for a ten-minute physical medicine encounter. A fifty-minute therapy hour is a different document and a different legal object.

Two things decide it before features do. Psychotherapy notes have heightened protection under HIPAA and generally need specific authorisation.6 And if you treat substance use disorder, 42 CFR Part 2 applies and is stricter than HIPAA.5 Freed's terms disallow Part 2 records outright.1

The law first

Psychotherapy notes are treated differently from the rest of the record under HIPAA. They sit at 45 CFR 164.508(a)(2), they generally require specific patient authorisation to disclose, and the treatment payment and operations permission that covers ordinary ambient documentation does not reach them the same way. If your scribe blends process notes into the progress note, you have created a disclosure problem that did not exist before.66Psychotherapy notes receive heightened protection under HIPAA at 45 CFR 164.508(a)(2) and generally require specific patient authorisation for disclosure, separate from treatment, payment and healthcare operations.

42 CFR Part 2 is stricter still. It governs substance use disorder records in federally assisted programmes and it restricts redisclosure in ways HIPAA does not. Read your vendor's terms rather than their marketing. Freed disallows Part 2 records in its terms of service, which is honest of them and you should know it before you sign up.

On consent, mental health is the setting where the state recording rules bite hardest. Sixteen states require every person in the room to agree, and a therapy patient has a stronger interest in that question than most. Our guide to consent covers it.

The document is different

A physical medicine note is a structured record of findings. A therapy note carries risk assessment, mental state, treatment plan progress and the clinician's formulation, and much of what matters happened in how something was said rather than in what was said. Most scribes in this market were trained and tuned on the first kind.

Length is a practical problem too. A fifty-minute session is five times a standard encounter and the summarisation task is not five times harder, it is differently hard.

What to ask

Ask whether the terms permit 42 CFR Part 2 records. Ask whether psychotherapy notes are separated from the progress note or blended into it. Ask what happens to the audio, because in this setting the recording is more sensitive than the note. Ask whether the product handles a fifty-minute session or times out. Then ask the ordinary questions, the BAA, the retention window and the training position.

One fact should shape your shortlist before anything else does. In a survey of 121 AI scribe products, only 7 percent explicitly claimed Class I medical device status, and of those only six could be definitively located on the MHRA register under the same or a clearly linked legal entity. Mental health is the setting where that gap matters most and it is the setting where the fewest vendors have closed it.

Where a therapy practice actually leaks

Not the note. The recurring hour that was cancelled on Sunday night and never refilled, the sliding-scale invoice that went out late, the intake enquiry that rang on a Tuesday and reached voicemail.

Roughly 13 to 19 percent of appointments are missed at about $196 each. In a practice built on a weekly hour, a missed session is not a gap in the diary. It is a break in the treatment.
